Work Permits

Canadian Work visa

Canada is full of opportunities for those looking to migrate for work. The lawyers at Bains Professional Corporation are specifically skilled to help you gather the necessary requirements to secure a work visa allowing you to work in Canada.

The chances of you receiving a Canadian work visa only increases if you already have a job offer from a Canadian employer, that is full-time and permanent. If the job is temporary, then you will most likely have better success applying for a temporary work permit. Let the lawyers at BPC help you with your visa application to ensure that you have all the required criteria to submit a successful application.

Express Entry

Express Entry is the most common route for foreign nationals to apply for Canadian Permanent Residence.

1. Express Entry Profile

To begin the application process, foreign nationals must create an Express Entry Profile online providing key information about themselves. Each factor is awarded points based on how the foreign national ranks.

Your Express Entry profile will get points based on:

  • Your education level (additional points are awarded if you have completed post-secondary education in Canada)

  • Your abilities in English and/or French (Canada's two official languages)

  • Your work experience and skills

  • Your age

  • If you have a job offer in Canada

  • Your spouse's education, language abilities and work experience

Their online profile will then be placed in a pool of candidates.

If the foreign national does not already have an offer of employment in Canada, he or she will be required to register with Canada's job bank which will help them to connect with Canadian employers.

2. Invitation to Apply

Once the foreign national’s profile has been submitted to the pool of EE candidates, the foreign national is ready for selection by the Minister of Immigration, Refugees and Citizenship Canada.

In regular time intervals, the Minister will select foreign nationals from the EE profile pool to apply for Canadian Permanent Residency by sending them an Invitation to Apply.  These rounds of selections are based entirely on EE profile points.

Eligibility Criteria

Only foreign nationals with at least one year full time paid employment, or two years part-time, are eligible to create an Express Entry profile.

Immigration candidates who have successfully been Invited to Apply for permanent residency will have 90 days to do so upon receiving their invitation. IRCC aims to process all Permanent Resident Applications within 6 months from the date of their submission.

If the application is approved, candidates along with their spouse and children (if applicable), will then become permanent residents of Canada.

If candidates in the pool do not receive an Invitation to Apply for permanent residency within 12 months, their EE profile will automatically expire.  At that point, a new Express Entry profile will need to be created.

Labour Market Impact Assessment

Some Canadian employers may require a Labour Market Impact Assessment before hiring a foreign worker. A positive LMIA will show that there is a need for a foreign worker to fill the job, because no Canadian worker is available to do the job.

If your employer requires an LMIA, you must do that first in order to apply for a work permit.

canadian start-up visa

Canada’s Start-Up Visa Program is for foreign national entrepreneurs who wish to migrate to Canada. Under this program you can apply for Canadian permanent residence based on the premise of you establishing a new company in Canada that will create employment. Before applying for permanent residence under this program, your business idea must first be approved and supported by a private sector organization.  These organizations specialize in helping to establish start-up businesses.
